4. Substance Use Disorder (SUD) Records — 42 CFR Part 2 Notice
If any portion of your care involves records related to a substance use disorder, those records are protected under federal confidentiality regulations at 42 CFR Part 2, in addition to HIPAA.
Under 42 CFR Part 2, SUD-related records generally may not be disclosed or used to investigate or prosecute a patient in any criminal proceeding without a court order, and may not be redisclosed by a recipient without your specific written consent, except in limited circumstances permitted by law (such as medical emergencies, certain audits, or as otherwise authorized under Part 2’s alignment with HIPAA disclosure rules).
